Motorized Skateboards, Scooters, Mini-Bikes, and Bicycles OrdinancePurpose: The purpose of the ordinance is to control the use of gasoline and electric powered skateboards, scooters, mini-bikes, and bicycles and to protect both the operators of said vehicles as well as the users of the Town of Danville's public ways. Definitions: Motorized Skateboard, Scooter, Mini-bike, and Bicycle: Shall mean but not be limited to, any vehicle and/or device that are propelled by a motor and/or engine that uses gasoline and/or electricity. Said vehicles being of such a size or configuration that they are not eligible to be registered for operation by the State of New Hampshire on a way. Way: A Way shall mean the entire width between the boundary lines of any public highway, street, avenue, road, alley, park, or parkway or any private way laid out according to statute and to include any parking lot both public and private where these areas are intended for use by the motoring public. The definition of a Way can be read in its entirety in RSA: 259:125 in the Motor Vehicle Code. Ordinance: Any motorized skateboard, scooter, mini-bike, or bicycle either gasoline and/ or electric powered that cannot obtain registration from the State of New Hampshire is prohibited from operation on any way within the Town of Danville. These vehicles may only be operated on private property with written permission from the landowner unless the operator is on his/her own property. No part of this ordinance shall apply to any person who is physically challenged and cannot walk and requires the use of a motorized device for mobility. Violations: Any violation of this ordinance shall result in the fine of $50.00 dollars for a first offense and the vehicle being impounded for a period up to 30 days. A subsequent offense shall carry a fine of $100.00 dollars and the vehicle being impounded for a period of 30 days. Community service shall be considered a viable alternative at the discretion of the courts for payment of fines.
